Bankruptcy is not an easy decision.

There are many factors that must be taken into account and the Bankruptcy Code is quite complex. Each case presents a unique set of facts that have to be carefully evaluated under the Bankruptcy Code. You need a qualified attorney working hard on your side.

In the consumer context, Bankruptcy can be a tremendous tool that can be used by individuals to “re-start” their financial circumstances. Unlike debt consolidation and credit counseling, Bankruptcy offers a final solution to an individual’s current financial crisis.

Debt consolidation programs lack the finality of the Bankruptcy process and require already cash strapped individuals to enter into monthly payment programs in an effort to settle the debt with their creditors. They are also entirely dependent on the individual creditor’s willingness to enter into the negotiation process and refrain from collection activities while the program is in effect.

In order to help understand what Bankruptcy can help with, we have compiled a short list of questions and answers that frequent many of our clients. This list is not intended to be exclusive. If your situation does not fit within any of the situations below, feel free to give the office a call. Remember, all Bankruptcy consultations are free of charge.

Debt Settlement

Debt settlement is an alternative to bankruptcy.  Our firm will attempt to negotiate with your creditors to achieve a reduction in the balance that you owe them.  We will also try to negotiate a more favorable payment term/program with creditors that refuse to accept a reduced settlement.

In order to accomplish this we use financial information you provide and estimate how much you can afford to pay to your creditors each month.  This figure becomes your monthly payment and you agree to deposit it each month into a bank account.  As time passes your funds will accumulate and we are then able to offer each of your creditors a percentage settlement based on the available accumulated funds.
